The above-captioned matter was heard as a contested case on March 12, 2009, at which time the complainant and the respondent appeared. This matter was consolidated for hearing with Docket #FIC 2008-734, Edward St. John v. First Selectman, Town of Middlebury.
After the hearing commenced, the parties reported that they had reached a settlement and requested that the complaint in this matter be withdrawn. An agreement, signed by both parties, was presented to the hearing officer, and states, in relevant part, as follows:
The respondent, first selectman, town of Middlebury, in FIC #2008-763…hereby certifies that he has made available all records responsive to the requests of Edward St. John. Any records sought in these requests that were not provided do not exist. As a result of this certification, the complainant hereby withdraws…[the] complaint[].
The Commission takes administrative notice of such letter.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
