The above-captioned matter was scheduled to be heard as a contested case on March 12, 2009, at which time the complainant and the respondent appeared.  This matter was consolidated for hearing with Docket #FIC 2008-763, Edward St. John v. First Selectman, Town of Middlebury.

 

After the hearing commenced, the parties requested a continuance of the matter, in order to discuss settlement.  Such request was granted by the hearing officer.   By email dated April 2, 2009, the complainant withdrew his complaint, stating that he had received the requested records.

 

The Commission takes administrative notice of such email.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

  1. Based on the withdrawal of the complaint, the case is hereby dismissed.
