The above-captioned matter was scheduled to be heard as a contested case on
May 5, 2009, at which time the complainant and the respondent appeared.
At such time, the complainant and the respondent informed the Commission
that they had reached an agreement settling the complaint.
Specifically, the respondent agreed that, going forward, it will comply with
the requirements of the FOI Act. The respondent further agreed to
arrange for an FOI Act training session to be conducted by the staff of the
FOI Commission.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Based on the parties’ agreement, the case is hereby dismissed.
2. The Commission commends the parties on having reached a non-litigated settlement in this matter.
