The above-captioned matter was heard as a contested case on November 6, 2008, at which time the complainants and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.
After consideration of the entire record, the following facts are found and conclusions of law are reached:
1. The respondents are public agencies within the meaning of §1-200(1), G. S.
2. It is found that, by email dated June 13, 2008, the complainants requested that the respondents provide them with an opportunity to inspect all records in the respondents’ possession concerning a June 4, 2008 suicide that occurred at the parking garage at the MGM Grand Casino in Ledyard. It is further found that the complainants were especially interested in the name of the decedent at such time. It is found that, by such e-mail, the respondents also renewed a previous request for the report on the suicide of Raymond Sayre, which occurred in Enfield on April 17, 2008.
3. It is found that, by letter dated June 17, 2008, to the complainants, the respondents acknowledged the request described in paragraph 2, above, and informed the complainants that the search fee for each investigative report is eight dollars, pursuant §29-10b, G. S.
4. It is found that, by letter dated June 24, 2008, the complainants provided the eight dollar fee, renewed their request for records, and specified that they wished the records in the current form, if not finalized.
5. It is found that by letter dated July 2, 2008, the respondents informed the complainants that the investigation regarding the June 4, 2008 suicide was still pending and that such records could not be provided at the time.
6. By letter dated July 15, 2008, and filed on July 17, 2008, the complainants appealed to the Commission, alleging that the respondents violated the Freedom of Information (“FOI”) Act by failing to comply with their requests as described in paragraphs 2 and 4, above.
7. Section 1-200(5), G. S., defines public records to mean:
… any recorded data or information relating to the conduct of the public's business prepared, owned, used, received or retained by a public agency, or to which a public agency is entitled to receive a copy by law or contract under section 1-218, whether such data or information be handwritten, typed, tape-recorded, printed, photostated, photographed or recorded by any other method.
8. Section 1-210(a), G.S., provides in relevant part:
Except as otherwise provided by any federal law or state statute, all records maintained or kept on file by any public agency, whether or not such records are required by any law or by any rule or regulation, shall be public records and every person shall have the right to (1) inspect such records promptly during regular office or business hours, (2) copy such records in accordance with subsection (g) of section 1-212, or (3) receive a copy of such records in accordance with section 1-212.
9. Section 1-212(a), G. S., provides in relevant part that “[a]ny person applying in
writing shall receive, promptly upon request, a plain or certified copy of any public record.”
10. It is found that the records requested by the complainants are public records, within the meaning of §1-200(5), G.S.
11. The Commission takes administrative notice of the record and final decision in Docket # FIC2008-607; David Collins and the New London Day v. Commissioner, State of Connecticut, Department of Public Safety; and State of Connecticut, Department of Public Safety (Feb. 27, 2009) (hereinafter “Docket #FIC 2008-607”). The Commission notes that Docket #FIC2008-607 has been appealed by the respondents.
12. It is found that, in Docket #FIC 2008-607, the complainants therein requested copies of records concerning the June 4, 2008 suicide at the MGM Grand Hotel/Casino. Paragraphs 13 through 16, below, replicate findings and conclusions in Docket #FIC 2008-607 which are pertinent to this case.
13. It is found that the respondents’ investigation into the MGM Grand suicide was signed and completed by June 22, 2008. It is found that the respondents intended to reopen the investigation upon the completion of the Medical Examiner’s report. It is found that the respondents nevertheless failed to provide the complainants with a copy of the report in response to the request described in paragraph 4, above.
14. It is found that the Medical Examiner sent his report to the respondents on July 3, 2008, but the respondents did not reopen the investigation until September 8, 2008. It is further found that the investigation was closed again on September 9, 2008.
15. It is found that the respondents did not provide any copies of the records until October 24, 2008, when they gave the complainants redacted copies.
16. It is found that the respondents failed to provide a reasonable explanation for the delay in providing the complainants with copies of the records they requested, described in paragraphs 2 and 4, above. Accordingly, it is concluded that the respondents violated the promptness requirements of §1-212(a), G.S.
17. In Docket #FIC 2008-607, the respondents provided the Commission with in camera documents, identified as IC-2008-607-1 through IC-2008-607-216. The exemptions claimed in the instant matter with respect to the MGM Grand suicide are the same as those claimed in Docket #FIC 2008-607, except that in such matter, §14-10, G.S., was also claimed. For the sake of consistency, the Commission shall consider §14-10, G.S., herein. Paragraphs 18 through 47, below, replicate findings and conclusions in Docket #FIC 2008-607 which are pertinent to this case.
18. The respondents claim that §1-210(b)(2), G.S., exempts from mandatory disclosure all or part of the following records identified as: IC-2008-607-1 through IC-2008-607-7, IC-2008-607-9 through IC-2008-607-13, IC-2008-607-25 through IC-2008-607-92, IC-2008-607-103 through IC-2008-607-106, IC-2008-607-108 through IC-2008-607-110, IC-2008-607-117 through IC-2008-607-120, IC-2008-607-122, and IC-2008-607-125 through IC-2008-607-215.
19. Section 1-210(b)(2), G.S., exempts disclosure of “personnel or medical files and similar files the disclosure of which would constitute an invasion of personal privacy.”
20. In Perkins v. Freedom of Information Commission, 228 Conn. 158, 175 (1993), the Supreme Court set forth the test for the exemption contained in §1-210(b)(2), G.S. The claimant must first establish that the files in question are personnel, medical or similar files. Second, the claimant must show that disclosure of the records would constitute an invasion of personal privacy. In determining whether disclosure would constitute an invasion of personal privacy, the claimant must establish both of two elements: first, that the information sought does not pertain to legitimate matters of public concern, and second, that such information is highly offensive to a reasonable person. The Commission takes administrative notice of the multitude of court rulings, commission final decisions,1 and instances of advice given by the Commission staff members,2 which have relied upon the Perkins test, since its release in 1993.
21. In Connecticut Alcohol and Drug Abuse Commission, et al, v. Freedom of Information Commission (“CATIC”), et al., 233 Conn. 28 (1995), the Supreme Court further expounded on the test for the exemption contained in §1-210(b)(2), G.S:
We conclude that such a determination requires a functional review of the documents at issue. Just as a "medical" file of an individual has as one of its principal purposes the furnishing of information for making medical decisions regarding that individual, a "personnel" file has as one of its principal purposes the furnishing of information for making personnel decisions regarding the individual involved. If a document or file contains material, therefore, that under ordinary circumstances would be pertinent to traditional personnel decisions, it is "similar" to a personnel file. Thus, a file containing information that would, under ordinary circumstances, be used in deciding whether an individual should, for example, be promoted, demoted, given a raise, transferred, reassigned, dismissed or subject to other such traditional personnel actions, should be considered "similar" to a personnel file for the purposes of §1-[210](b)(2).

22. Upon careful review of the in camera records, it is found that, with the exception of IC-2008-607-106, IC-2008-607-108 and IC-2008-607-109, the respondents failed to prove that any of the redactions of the records described in paragraph 18, above, constitute personnel files or medical files or similar files, within the meaning of §1-210(b)(2), G.S. Rather, it is found that such records are “fundamentally the report of…[a] police officer[] charged with investigating the death.” See Town of Putnam v. Commissioner, State of Connecticut, Department of Public Safety; and State of Connecticut, Department of Public Safety, Docket #FIC 2007-580 (May 28, 2008); Ralph W. Williams and Journal Inquirer v. Chief, Police Department, Town of Vernon, Docket #FIC 2002-164 (March 26, 2003).
23. It is found that IC-2008-607-106, IC-2008-607-108, and IC-2008-607-109 are entitled without redaction as “Medications I am taking regularly or as needed.” It is found that the respondents claimed that, aside from the title, the contents of such records are exempt, and the respondents redacted the contents when they provided such records to the complainants. It is found that such records have as one of their “principal purposes the furnishing of information for making medical decisions regarding that individual.” CATIC, supra. It is found, therefore, that the redacted information is a record similar to a medical file, within the meaning of §1-210(b)(2), G.S.
24. It is found, however, that the individual to whom such personal medication card applies is deceased.
25. The Supreme Court, in Perkins, supra, construed the term “invasion of personal privacy” according to its common-law meaning and adopted the definition for invasion of privacy set forth in 3 Restatement (Second) Torts Section §652I of the Restatement provides, in relevant part, that a claim “ . . . for invasion of privacy can be maintained only by a living individual whose privacy is invaded.” The commentary accompanying §652I provides that in the absence of statute, an action for invasion of privacy cannot be maintained after the death of the individual.
26. It is concluded, therefore, that disclosure of the requested records described in paragraph 18, above, would not be an invasion of personal privacy, because no such privacy right exists with respect to the deceased. See Crowley v. Commissioner, State of Connecticut, Department of Public Health, Docket #FIC 2007-123 (August 8, 2007); and David K. Jaffe v. State of Connecticut, Connecticut Lottery Corporation Docket #FIC1999-019 (April 29, 1999). (Disclosure of deceased employee’s personnel files would not be an invasion of privacy because privacy rights terminate at death.)
27. It is found that IC-2008-607-103, IC-2008-607-125, and IC-2008-607-126 contain account numbers of the deceased’s credit cards, health insurance policy, and other memberships. At the hearing, the complainants testified that they do not seek such records.
28. It is concluded that the respondents violated the FOI Act by failing to provide copies of records described in paragraph 18, above, except for the records described in paragraph 27, above.
29. The respondents claim that §1-210(b)(3)(B), G.S., exempts IC-2007-607-11 from mandatory disclosure. Section 1-210(b)(3)(B), G.S., exempts “[r]ecords of law enforcement agencies not otherwise available to the public which records were compiled in connection with the detection or investigation of crime, if the disclosure of said records would not be in the public interest because it would result in the disclosure of…signed statements of witnesses…”
30. It is found that the records requested by the complainants, described in paragraph 2, above, were not compiled in connection with the detection or investigation of crime, within the meaning of §1-210(b)(3), G.S.
31. It is found, therefore, that although IC-2008-607-11 is a signed statement of a witness, the record was not compiled in connection with the detection or investigation of crime. Accordingly, it is concluded that IC-2008-607-11 is not exempt from mandatory disclosure and the respondents violated the FOI Act by failing to disclose such record to the complainants.
32. The respondents claim that §1-210(b)(5)(B), G.S., exempts from mandatory disclosure IC-2008-607-25 through IC-2008-607-93, IC-2008-607-117 through IC-2008-607-120, IC-2008-607-125, IC-2008-607-126, and IC-2008-607-127 through IC-2008-607-215. Section 1-210(b)(5)(B), G.S., exempts disclosure of “commercial or financial information given in confidence, not required by statute[.]”
33. It is found that the records described in paragraph 32, above, are the casino’s records of the deceased’s gambling activity at the casino. It is found that the respondents failed to prove that such financial information was given to the respondents in confidence, within the meaning of §1-210(b)(5)(B), G.S.
34. It is found, therefore, that §1-210(b)(5)(B), G.S., does not exempt the records described in paragraph 32, above. It is concluded that the respondents violated the FOI Act by failing to disclose such records to the complainants.
35. The respondents claim that §19a-411, G.S., prohibits the disclosure of IC-2008-607-7, IC-2008-607-13, IC-2008-607-14 through IC-2008-607-23, IC-2008-607-124, and IC-2008-607-216. Section 19a-411, G.S., provides in relevant part:
(b) The report of examinations conducted by the Chief Medical Examiner, Deputy Chief Medical Examiner, an associate medical examiner or an authorized assistant medical examiner, and of the autopsy and other scientific findings may be made available to the public only through the Office of the Chief Medical Examiner and in accordance with this section, section 1-210 and the regulations of the commission [Commission on Medicolegal Investigations].
36. It is found that, except for IC-2008-607-7 and IC-2008-607-13, the records described in paragraph 35, above, are reports of examinations conducted by the Chief Medical Examiner, of the autopsy and other scientific findings, within the meaning of §19a-411, G.S. Accordingly, it is concluded that the respondents do not have the statutory authority to disclose such records, and did not violate the FOI Act by not providing them to the complainants.
37. With respect to IC-2008-607-7 and IC-2008-607-13, however, it is found that such records are records of the respondents’ investigators, not records of examinations conducted by the Chief Medical Examiner or records of the autopsy or of other scientific findings, within the meaning of §19a-411(b), G.S.
38. It is found that §19a-411(b), G.S., does not exempt from disclosure the redactions in IC-2008-607-7 and IC-2008-607-13. It is concluded that the respondents violated the FOI Act by failing to disclose such records.
39. The respondents claim §14-10, G.S., prohibits disclosure of the deceased’s operator’s license number, on line 4 of IC-2008-607-118 through IC-2008-607-120. Section 14-10, G.S., provides:
(f) The commissioner may disclose personal information from a motor vehicle record to:
(1) Any federal, state or local government agency in carrying out its functions or to any individual or entity acting on behalf of any such agency[.]
40. It is found that line 4 of IC-2008-607-118 through IC-2008-607-120 is the deceased’s operator number. It is found that the MGM Grand gave the records that contain the deceased’s operator number to the respondents in order to assist the investigation.
41. Section 14-10(d), G.S., “only prohibits the dissemination of such information by the commissioner of the department of motor vehicles.” Kirschner v. FOI Commission, 1998 Conn. Super. LEXIS 110, CV 970567162, New Britain, J.D., at New Britain, Jan. 15. 1998.
42. It is found that IC-2008-607-118 through IC-2008-607-120 are public records of the respondents, not of the Commissioner of the Department of Motor Vehicles.
43. It is concluded that §14-10, G.S., does not exempt line 4 of IC-2008-607-118 through 120 from disclosure. It is concluded that the respondents violated the FOI Act by failing to disclose such information to the complainants.
44. The respondents claim that §29-164f, G.S., and 42 U.S.C. §14616 prohibit disclosure of IC-2008-607-111 and IC-2008-607-112, which the respondents identify as National Criminal History Information. It is found that §29-164f, G.S., and 42 U.S.C. §14616 set forth the National Crime Prevention and Privacy Compact, to which Connecticut and the U.S. Federal Bureau of Investigation are contracting parties.
45. It is found that IC-2008-607-111 and 112 are print-outs from the respondents’ electronic inquiry about the deceased to the National Crime Information Center, which is the computerized database of criminal history information accessible to the respondents through the National Crime Prevention and Privacy Compact, described in paragraph 44, above.
46. It is concluded, however, that a public agency may not contract away its statutory obligations under the FOI Act. Lieberman v. Board of Labor Relations, 216 Conn. 253 (1990).
47. It is concluded, therefore, that neither §29-164f, G.S., nor 42 U.S.C. §14616 prohibit the disclosure of the NCIC printouts, identified as IC-2008-607-111 and 112. It is also concluded that the respondents violated the FOI Act by failing to disclose such records to the complainants.
48. With respect to the records related to the April 2008 suicide in Enfield, it is found that, unlike the MGM Grand suicide report, such report was not in existence at the time of the request and complaint in this matter. However, the respondents maintained some contemporaneous records responsive to the complainants’ request, as described in paragraph 4, above.
49. At the hearing in this matter, the respondents contended that the records they had at the time of the request and complaint in this matter were exempt from disclosure pursuant to §1-210(b)(1), G. S.
50. Section 1-210(b)(1), G.S., provides in relevant part that nothing in the FOI Act shall be construed to require disclosure of “preliminary drafts or notes provided the public agency has determined that the public interest in withholding such documents clearly outweighs the public interest in disclosure . . . .”
51. Section 1-210(e)(1), G.S., provides in relevant part that notwithstanding the provisions of §1-210(b)(1), G.S., disclosure shall be required of:
[i]nteragency or intra-agency memoranda or letters, advisory opinions, recommendations or any report comprising part of the process by which governmental decisions and policies are formulated, except disclosure shall not be required of a preliminary draft of a memorandum, prepared by a member of the staff of a public agency, which is subject to revision prior to submission to or discussion among the members of such agency.
52. In Shew v. Freedom of Information Commission, the Supreme Court ruled that “the concept of preliminary [drafts or notes], as opposed to final [drafts or notes], should not depend upon . . . whether the actual documents are subject to further alteration . . .” but rather “[p]reliminary drafts or notes reflect that aspect of the agency’s function that precede formal and informed decision making . . . . It is records of this preliminary, deliberative and predecisional process that . . . the exemption was meant to encompass.” Shew v. Freedom of Information Commission, 245 Conn. 149, 165 (1998).
53. It is found that records relative to the investigation into the Enfield suicide were preliminary drafts or notes at the time of the request and complaint in this matter. It is found that the respondents determined that the public interest in withholding such records outweighed the public interest in disclosing such records, within the meaning of §1-210(b)(1), G. S.
54. It is found that, at the time of the request and complaint in this matter, the existing records did not constitute interagency or intra-agency memoranda or letters, advisory opinions, recommendations or any report comprising part of the process by which governmental decisions and policies are formulated, within the meaning of §1-210(e)(1), G. S.
55. It is concluded that the Enfield records were exempt from mandatory disclosure at the time of the complaint in this matter. Accordingly, it is concluded that the respondents did not violate the FOI Act by denying the complainants copies of such records at such time.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.
1. Henceforth, the respondents shall strictly comply with the promptness provisions of §§1-210(a) and 1-212(a), G.S.
2. The respondents forthwith shall provide to the complainants free of charge a copy of the requested records as directed in paragraphs 28, 31, 34, 38, 43, and 47 of the findings of fact, above.
3. The respondents shall also provide to the complainants copies of any site photographs that they maintain of the MGM Grand Casino which do not include a depiction of Mr. Sherman. Such photographs were not at issue in Docket #FIC 2008-607.

1. I am over the age of eighteen (18) years and understand the obligation of an affirmation.
2. I am a member of the Connecticut Bar and am currently employed as Director of Public Education for the Connecticut Freedom of Information Commission, having first been employed by said commission in 1996.
3. I am providing this affidavit in light of the Supreme Court decision in Director, Retirement & Benefits Services Division v. Freedom of Information Commission, 256 Conn. 764 (2001), in which the court apparently invites a reconsideration of Perkins v. Freedom of Information Commission, 228 Conn. 158 (1993). See, Director, supra at 782, fn 13, 785 (Zarella, J. concurring).
4. As part of my responsibilities as Director of Public Education for said commission, I have developed, organized and scheduled speaking engagements, seminars and programs explaining the duties and rights established under the Connecticut Freedom of Information Act.
5. Since I assumed my current position in 1996, there have been approximately 290 such speaking engagements, seminars and programs in Connecticut and I have personally lectured in approximately 80 such speaking engagements, seminars and programs.
6. As part of the presentation I have prepared for such speaking engagements, seminars and programs, the subject of the Connecticut General Statues Section 1-210(b)(2) exemption for personnel, medical and similar files the disclosure of which would constitute an invasion of personal privacy is stressed because of the great interest in that exemption and the confusion generated by a series of inconsistent and contradictory court decisions prior to Perkins, supra. See, e.g., Chairman v. Freedom of Information Commission, 217 Conn. 193 (1991) (establishing “reasonable expectation of privacy” test; query whether subjectively or objectively applied) and Board of Education v. Freedom of Information Commission, 210 Conn. 590 (1989) (confirming a “balancing” test), which was overruled by the Chairman case.
7. Since the Supreme Court ruling in Perkins, supra, all Freedom of Information Commission staff members who conduct such speaking engagements, seminars and programs discuss in detail the rulings in that case and its progeny.
8. As part of my responsibilities as Director of Public Education, I also answer telephone and other inquiries from public officials and the public. Since my employment with said commission, I have answered thousands of such inquiries, including hundreds of inquiries concerning the Connecticut General Statutes Section 1-210(b)(2) exemption. In responding to such inquiries I discuss in detail the Perkins case and its progeny.
9. Based on the foregoing experiences, it is my opinion that the Perkins decision, and its progeny, have had a beneficial effect on public officials and the public itself because they can rely on a now long-standing and clear test with respect to the Connecticut General Statutes Section 1-210(b)(2) exemption, which helps them determine whether that exemption is applicable to the practical problems they encounter with respect to personnel, medical and similar information. Indeed, the many court and Freedom of Information Commission decisions applying the Perkins test have given public officials and the public a now consistent body of law concerning that statutory exemption.
