The above-captioned matter was heard as a contested case on October 20, 2009, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  During the hearing, the parties asked to try to resolve their differences outside of the context of a contested case, and informed the Commission that the complainant would thereafter notify the Commission whether he wished to withdraw his complaint or if a further hearing would be necessary.  On November 4, 2009, the complainant informed the Commission that he had been provided with all information that he had requested and that he wished to withdraw the complaint.

 

The Commission takes administrative notice of the complainant’s withdrawal and recommends the following orders on the basis of the record:

 

1.  Based on the withdrawal of the complaint, the case is hereby dismissed.

 

2.  The Commission commends the parties on having reached a settlement without full adjudication.
