The above-captioned matter was heard as a contested case on October 26, 2009, at which time the complainant and respondents appeared, stipulated to certain facts and presented  testimony, exhibits and argument on the complaint.

 

Toward the conclusion of the hearing in this matter, the complainant withdrew all portions of his complaint against the respondents City of Milford Chief of Police and Police Department and the Town of Orange Chief of  Police and Police Department.  The complainant also withdrew a portion of his complaint against the respondents Lieutenant J. Paul Vance, Commanding Officer for the Connecticut State Police and the Department of Public Safety (hereinafter, collectively referred to as “DPS”). 

 

By facsimile dated and filed on November 18, 2009, the complainant notified the Commission that in light of the release by the respondent DPS of the outstanding digital video recording at issue in this matter, it wished to withdraw all remaining claims in this case against DPS.  The Commission takes administrative notice of such facsimile.

 

 

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

                                                                       

1.       The complaint is hereby dismissed.
