The above-captioned matter was scheduled for hearing as a contested case on March 4, 2010, at which time the respondents appeared, but the complainant failed to appear. The respondents presented an exhibit and brief argument on the complaint.
The Commission notes that the complainant recently received an adverse decision from the Commission in Docket #FIC 2009-145; Thomas Germain v. Town Clerk, Town of Manchester; and Town of Manchester, wherein the complainant used the exact same model of flatbed scanner which he alleged using in this case.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed for failure to prosecute.
