The above-captioned matter was scheduled for hearing as a contested case on April 26, 2010, at which time the respondents appeared, but the complainant failed to appear. Counsel for the respondents stated that the requested records had been furnished to the complainant, without any claim of exemption, including over fifty pages and three oversized maps.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed for failure to prosecute.
