The above-captioned matter was heard as a contested case on November 3, 2009, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. For purposes of hearing, this matter was consolidated with Docket #FIC 2009-502; Joćo Godoy v. Mark Rinaldo, Chief, Police Department, Town of Avon; and Police Department, Town of Avon. After consideration of the entire record, the following facts are found and conclusions of law are reached:
1. The respondents are public agencies within the meaning of §1-200(1), G.S.
2. It is found that on July 7, 2009, July 16, 2009, and August 5, 2009, the complainant made written requests to inspect copies of certain personnel records and incident reports maintained by the respondents.
3. By letters filed on July 28, 2009 and August 31, 2009, the complainant appealed to this Commission, alleging that the respondents violated the Freedom of Information (“FOI”) Act by failing to provide access to copies of all of the records he requested, described in paragraph 2, above.
4. Section 1-200(5), G.S., in relevant part, defines “public records” as follows:
Public records or files means any recorded data or information relating to the conduct of the public's business prepared, owned, used, received or retained by a public agency, …whether such data or information be handwritten, typed, tape-recorded, printed, photostated, photographed or recorded by any other method.
5. Section 1-210(a), G.S., provides, in relevant part:
Except as otherwise provided by any federal law or state statute, all records maintained or kept on file by any public agency, whether or not such records are required by any law or by any rule or regulation, shall be public records and every person shall have the right to inspect such records promptly during regular office or business hours or to receive a copy of such records in accordance with the provisions of section 1-212.
6. Section 1-212 (a), G.S., provides in relevant part: “Any person applying in writing shall receive, promptly upon request, a plain or certified copy of any public record.”
7. It is concluded that the records requested by the complainant are public records within the meaning of §§1-200(5), 1-210(a), and 1-212(a), G.S.
8. It is found that the respondents permitted the complainant to inspect copies of many of the records that the complainant requested.
9. It is found that the respondents did not disclose some records because they claimed the records were exempt from mandatory disclosure under the FOI Act.
10. After the hearing in this matter, the respondents submitted unredacted copies of the records described in paragraph 9, above, for in camera inspection, which pages shall be identified herein as IC-2009-437-1 through IC-2009-437-24. The respondents subsequently submitted unredacted copies of additional records described in paragraph 9, above, for in camera inspection, which pages shall be identified herein as IC-2009-437-1-a through IC-2009-437-71-a.
11. It is found that the respondents publicly identify IC-2009-437-1 in the Index to Records Submitted for In Camera Inspection as the criminal record of one of the applicants who was subsequently hired as an Avon police officer. It is found that the respondents publicly identify IC-2009-437-2 in the Index as the criminal record of another applicant who was subsequently hired as an Avon police officer.
12. The respondents claim that IC-2009-437-1 and IC-2009-437-2 are exempt from disclosure pursuant to §1-210(b)(2), G.S., which provides in relevant part that nothing in the FOI Act shall require the disclosure of “personnel or medical files and similar files the disclosure of which would constitute an invasion of personal privacy. . .”
13. Upon careful examination of IC-2009-437-1 and IC-2009-437-2, it is found that such records constitute personnel files, within the meaning of §1-210(b)(2), G.S.
14. Section 1-214(b), G.S., provides in relevant part:
“Whenever a public agency receives a request to inspect or copy records contained in any of its employees’ personnel or medical files and similar files and the agency reasonably believes that the disclosure of such records would legally constitute an invasion of privacy, the agency shall immediately notify in writing (1) each employee concerned . . . and (2) the collective bargaining representative, if any, of each employee concerned. Nothing herein shall require an agency to withhold from disclosure the contents of personnel or medical files and similar files when it does not reasonably believe that such disclosure would legally constitute an invasion of personal privacy.
15. Section 1-214(c), G.S., provides in relevant part:
A public agency which has provided notice under subsection (b) of this section shall disclose the records requested unless it receives a written objection from the employee concerned … within seven business days from the receipt by the employee …Each objection filed under this subsection shall be on a form prescribed by the public agency, which shall consist of a statement to be signed by the employee … under the penalties of false statement, that to the best of his knowledge, information and belief there is good ground to support it and that the objection is not interposed for delay. Upon the filing of an objection as provided in this subsection, the agency shall not disclose the requested records unless ordered to do so by the Freedom of Information Commission pursuant to section 1-206.
16. It is found that the respondents reasonably believed that disclosure of IC-2009-437-1 and IC-2009-437-2 would legally constitute an invasion of privacy. It is found that the subjects of such records are employees of the Avon Police Department. It is further found that the respondents notified them of the complainant’s request for records, and that both employees objected in writing to the disclosure of the portion of their personnel files described in paragraph 11, above. It is found that the employees’ objections were not interposed for delay.
17. The complainant contends that a waiver of confidentiality that each employee executed “for the purposes of [his] employment application” applies to waive any objection the employees may raise pursuant to §1-214(c), G.S. It is found, however, that such waiver by its terms applied only for disclosure of records to the Town of Avon, and did not apply to disclosure of such records to the public pursuant to the FOI Act.
18. The Supreme Court set forth the test for the exemption contained in §1-210(b)(2), G.S., in Perkins v. Freedom of Information Commission, 228 Conn. 158, 175 (1993). The claimant must first establish that the files in question are personnel, medical or similar files. Second, the claimant must show that disclosure of the records would constitute an invasion of personal privacy. In determining whether disclosure would constitute an invasion of personal privacy, the claimant must establish both of two elements: first, that the information sought does not pertain to legitimate matters of public concern, and second, that the disclosure of such information is highly offensive to a reasonable person. The Commission takes administrative notice of the multitude of court rulings, commission final decisions,1 and instances of advice given by the Commission staff members,2 which have relied upon the Perkins test, since its release in 1993.
19. With respect to IC-2009-437-1, it is found that line 16 does not pertain to legitimate matters of public concern and the disclosure of such information would be highly offensive to a reasonable person, due to the minor nature of the offense, which is an infraction under Connecticut law. It is found, moreover, based on testimony provided at the hearing in this matter, that the incident occurred more than ten years ago, when the applicant was 17 years old.
20. It is found, therefore, that disclosure of the information in line 16 of IC-2009-437-1 would constitute an invasion of privacy. Accordingly, it is concluded that line 16 of such record is exempt from disclosure.
21. With respect to IC-2009-437-2, it is found that lines 12 through 17 describe behavior that resulted in the applicant’s guilty plea to an infraction. It is found, based on testimony provided at the hearing in this matter, that the incident occurred nearly 10 years ago, when the applicant was a college student. It is found that the information in lines 12 through 17 of IC-2009-437-2 does not pertain to legitimate matters of public concern and the disclosure of such information would be highly offensive to a reasonable person.
22. It is found, therefore, that disclosure of the information in lines 12 through 17 of IC-2009-437-2 would constitute an invasion of privacy. Accordingly, it is concluded that lines 12 through 17 of IC-2009-437-2 are exempt from disclosure.
23. With respect to the remainder of IC-2009-437-1 and of IC-2009-437-2, however, it is found that the redacted information pertains to legitimate matters of public concern and the disclosure of such information would not be highly offensive to a reasonable person. It is found, therefore, that disclosure of such records would not constitute an invasion of personal privacy. It is concluded that such records are not exempt from disclosure pursuant to §1-210(b)(2), G.S., and the respondents violated the FOI Act by failing to disclose them.
24. With respect to IC-2009-437-3 through IC-2009-437-12, the respondents claim such records are exempt from disclosure pursuant to §1-210(b)(3)(G), G.S., which provides that disclosure is not required of:
Records of law enforcement agencies not otherwise available to the public which records were compiled in connection with the detection or investigation of crime, if the disclosure of said records would not be in the public interest because it would result in the disclosure of … (G) uncorroborated allegations subject to destruction pursuant to section 1-216 ….
25. Section 1-216, G.S., provides:
Except for records the retention of which is otherwise controlled by law or regulation, records of law enforcement agencies consisting of uncorroborated allegations that an individual has engaged in criminal activity shall be reviewed by the law enforcement agency one year after the creation of such records. If the existence of the alleged criminal activity cannot be corroborated within ninety days of the commencement of such review, the law enforcement agency shall destroy such records.
26. In contested case Docket #FIC 94-519, Rachel Gottlieb and The Hartford Courant v. State of Connecticut, Department of Public Safety, Division of State Police, (hereinafter “FIC 94-519”) the Commission found that Black's Law Dictionary, Sixth Edition (1990), defines “corroborate” as “to strengthen, to add weight or credibility to a thing by additional and confirming facts or evidence.” Ballentines Law Dictionary, Third Edition (1969) defines corroborate as “to state facts tending to produce confidence in the truth of a statement made by another.” Funk & Wagnall New Standard Dictionary of the English Language (1946) defines corroborate as “to give increased support to; make more sure or evident.”
27. In Docket #FIC 94-519, the Commission found that “the reports contain similar accounts relayed to the respondent by different interviewees concerning the allegations under investigation.” The Commission went on to find that “the requested reports contain allegations which were corroborated.”
28. In this case, it is found that the in camera records were compiled in connection with the detection or investigation of crime. It is found that the in camera records contain no similar accounts of the alleged criminal activity or any information that tends to strengthen, add weight or support the allegation of criminal activity.
29. It is found that the in camera records contain uncorroborated allegations within the meaning of §1-210(b)(3)(G), G.S.
30. Consequently, it is found that disclosure of the in camera records would result in the disclosure of uncorroborated allegations within the meaning of §1-210(b)(3)(G), G.S.
31. It is concluded, therefore, that IC-2009-437-3 through IC-2009-437-12 are permissibly exempt from mandatory disclosure under §§1-210(b)(3)(G) and 1-216, G.S. It is concluded that the respondents did not violate the disclosure provisions of §§1-210(a) and 1-212(a), G.S., by withholding such records from the complainant.
32. With respect to IC-2009-437-13 through IC-2009-437-18, the respondents claim such records are exempt pursuant to §1-210(b)(6), G.S., which provides in relevant part that nothing in the FOI Act shall require the disclosure of “test questions, scoring keys and other examination data used to administer a licensing examination, examination for employment or academic examinations . . . .”
33. It is found that the respondents publicly identify the records referenced in paragraph 32, above, as oral interview questions and answers of applicants for the position of police officer.
34. Upon careful examination of IC-2009-437-13 through IC-2009-437-18, it is found that such records contain oral interview questions, applicants’ responses, and scores awarded for each answer, as well as the total oral interview score, for three applicants for a position with the respondent police department.
35. It is found that the respondents permitted the complainant to inspect records containing the total oral interview score for each applicant.
36. It is found that IC-2009-437-13 through IC-2009-437-18 contain test questions … and other examination data used to administer an examination for employment, within the meaning of §1-210(b)(6), G.S. See, Washington v. FOIC, 25 Conn. L. Rptr. 334 (1999). It is also found that disclosure of only the notes of applicants’ responses to individual questions would reveal the test questions.
37. It is concluded, therefore, that IC-2009-437-13 through IC-2009-437-18 are exempt from disclosure.
38. On the Index to Records Submitted for In Camera Inspection, the respondents also claimed that §1-210(b)(2), G.S., applied to the records referenced in paragraph 36, above. It is not necessary to address such exemption, however, because those in camera records are exempt pursuant to §1-210(b)(6), G.S.
39. With respect to IC-2009-437-19 through IC-2009-437-24 and IC-2009-437-1-a through IC-2009-437-71-a, the respondents publicly identify such records in the Index as applicants’ polygraph reports. The respondents claim that the records are exempt pursuant to §§1-210(b)(2) and (6), G.S.
40. It is found that IC-2009-437-19 through IC-2009-437-24 and IC-2009-437-1-a through IC-2009-437-71-a are the responses, in narrative form, to the polygraph examinations of 16 applicants.
41. The respondents claim that the polygraph responses suggest the questions, which the respondents claim are exempt pursuant to §1-210(b)(6),G.S.
42. Upon careful examination of IC-2009-437-19 through IC-2009-437-24 and IC-2009-437-1-a through IC-2009-437-71-a, it is found that although the records were created as part of a town’s police officer selection process, the records were not used to administer an employment examination, within the meaning of §1-210(b)(6), G.S. Michael J. Proto v. Town of Hamden; Docket #FIC1995-295.
43. It is concluded, therefore, that the respondents failed to prove that the subject records are exempt from disclosure under §1-210(b)(6), G.S.
44. The respondents also claimed that §1-210(b)(2), G.S., exempts from disclosure the polygraph report contained in IC-2009-437-19 through IC-2009-437-24 and IC-2009-437-1-a through IC-2009-437-71-a.
45. It is found that IC-2009-437-19 through IC-2009-437-24 and IC-2009-437-1-a through IC-2009-437-71-a are similar to personnel files, within the meaning of §1-210(b)(2), G.S., because the records have “as one of [their] principal purposes the furnishing of information for making personnel decisions regarding the individual involved. Connecticut Alcohol and Drug Abuse Commission, et al, v. Freedom of Information Commission, et al., 233 Conn. 28 (1995).
46. It is found that the subjects of such records are employees and former employees of the Avon Police Department, and three applicants who were not hired. It is further found that the respondents notified all but one of the applicants of the complainant’s request for records, and that all applicants (except for one, who was not hired and who did not receive notice), objected in writing to the disclosure of the polygraph examination reports. It is found that the objections were not interposed for delay.
47. With respect to the reports of polygraph examinations of applicants who were not hired by the respondents, i.e., IC-2009-437-19 through IC-2009-437-24 and IC-2009-437-57-a through IC-2009-437-71-a, it is found that the information contained in such records does not pertain to legitimate matters of public concern and that disclosure of such information would be highly offensive to a reasonable person. It is found that disclosure of such records would constitute an invasion of personal privacy, within the meaning of §1-210(b)(2), G.S.
48. It is concluded, therefore, that the records referenced in paragraph 47, above, are permissively exempt from disclosure, and the respondents did not violate the FOI Act by not providing such records to the complainant.
49. With respect to reports of polygraph examinations of employees and former employees of the Avon Police Department, i.e., IC-2009-437-1-a through IC-2009-437-56-a, it is found that the information contained in the following categories in the reports does not pertain to legitimate matters of public concern and disclosure of such information would be highly offensive to a reasonable person: Medical and Mental Health History, Sexual Conduct, Financial History, and Social Security Number. In addition, it is found that any information concerning possible criminal activity by the applicant/polygraph subject under the age of 17 does not pertain to legitimate matters of public concern and disclosure of such information would be highly offensive to a reasonable person.
50. It is found that, in addition to the information in the records described in paragraph 49, above, the information in the following records does not pertain to legitimate matters of public concern and disclosure of such information would be highly offensive to a reasonable person:

51. It is found that disclosure of the records referenced in paragraphs 49 and 50, above, would constitute an invasion of personal privacy within the meaning of §1-210(b)(2), G.S. It is concluded that such records are permissively exempt from disclosure and that the respondents did not violate the FOI Act by not disclosing such records.
52. With respect to the remainder of the records of polygraph examinations, it is found that the information in such records pertains to legitimate matters of public concern by shedding light on the employees’ qualifications. It is concluded, therefore, that disclosure of the information would not constitute an invasion of privacy within the meaning of §1-210(b)(2), G.S.
53. Accordingly, it is concluded that the respondents violated the FOI Act by failing to disclose the records referenced in paragraph 52, above.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Forthwith, the respondents shall permit the complainant to inspect copies of the records described in paragraphs 23 and 52 of the findings of fact.

AFFIDAVIT OF ERIC V. TURNER
Eric V. Turner, having been duly sworn, does hereby depose as follows:
1. I am over the age of eighteen (18) years and understand the obligation of an affirmation.
2. I am a member of the Connecticut Bar and am currently employed as Director of Public Education for the Connecticut Freedom of Information Commission, having first been employed by said commission in 1996.
3. I am providing this affidavit in light of the Supreme Court decision in Director, Retirement & Benefits Services Division v. Freedom of Information Commission, 256 Conn. 764 (2001), in which the court apparently invites a reconsideration of Perkins v. Freedom of Information Commission, 228 Conn. 158 (1993). See, Director, supra at 782, fn 13, 785 (Zarella, J. concurring).
4. As part of my responsibilities as Director of Public Education for said commission, I have developed, organized and scheduled speaking engagements, seminars and programs explaining the duties and rights established under the Connecticut Freedom of Information Act.
5. Since I assumed my current position in 1996, there have been approximately 290 such speaking engagements, seminars and programs in Connecticut and I have personally lectured in approximately 80 such speaking engagements, seminars and programs.
6. As part of the presentation I have prepared for such speaking engagements, seminars and programs, the subject of the Connecticut General Statues Section 1-210(b)(2) exemption for personnel, medical and similar files the disclosure of which would constitute an invasion of personal privacy is stressed because of the great interest in that exemption and the confusion generated by a series of inconsistent and contradictory court decisions prior to Perkins, supra. See, e.g., Chairman v. Freedom of Information Commission, 217 Conn. 193 (1991) (establishing “reasonable expectation of privacy” test; query whether subjectively or objectively applied) and Board of Education v. Freedom of Information Commission, 210 Conn. 590 (1989) (confirming a “balancing” test), which was overruled by the Chairman case.
7. Since the Supreme Court ruling in Perkins, supra, all Freedom of Information Commission staff members who conduct such speaking engagements, seminars and programs discuss in detail the rulings in that case and its progeny.
8. As part of my responsibilities as Director of Public Education, I also answer telephone and other inquiries from public officials and the public. Since my employment with said commission, I have answered thousands of such inquiries, including hundreds of inquiries concerning the Connecticut General Statutes Section 1-210(b)(2) exemption. In responding to such inquiries I discuss in detail the Perkins case and its progeny.
9. Based on the foregoing experiences, it is my opinion that the Perkins decision, and its progeny, have had a beneficial effect on public officials and the public itself because they can rely on a now long-standing and clear test with respect to the Connecticut General Statutes Section 1-210(b)(2) exemption, which helps them determine whether that exemption is applicable to the practical problems they encounter with respect to personnel, medical and similar information. Indeed, the many court and Freedom of Information Commission decisions applying the Perkins test have given public officials and the public a now consistent body of law concerning that statutory exemption.
