The above-captioned matter was consolidated for hearing with Docket # FIC 2009-686, also captioned Paul Yoos v. Economic Development Commission, Town of Thomaston; and Town of Thomaston. Both cases were heard as contested cases on April 23, 2010, at which time both the complainant and the respondents appeared and presented testimony, exhibits and argument on the complaints.
During the hearing, the respondents suggested and the complainant agreed to resolve the above-captioned matter based upon the following stipulations:
1) The notice for the special meeting of the respondent Commission held on Sunday, October 18, 2009 was not timely filed, in violation of §§1-225(d) and 1-225(g), G.S.;
2) For a trial period of two years, commencing immediately following the final decision in this matter, the respondent Commission will have at all its meetings, for distribution to the public, ten copies of both the agenda and all proposed drafts that are subjects of the meeting agenda; and
3) Based upon the stipulations at paragraphs 1 and 2, above, the complainant agreed to withdraw his complaint in the above captioned matter.
The Commission takes administrative notice of the complainant’s withdrawal and recommends the following order on the basis of the record:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
