The above-captioned matter was scheduled for hearing as a contested case on June 16, 2010, at which time both the complainant and the respondents appeared. The parties requested that they be permitted to conduct a settlement conference, which was conducted without the presence of the hearing officer.
Following the settlement conference, the respondents informed the hearing officer that they had given the complainant an affidavit. Based upon the affidavit, the complainant stated that he wished to withdraw his complaint. The Commission takes administrative notice of such withdrawal.
The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The Commission warmly commends the parties on having reached a settlement of this matter without adjudication.
