The above-captioned matter was scheduled for hearing as a contested case on February 9, 2010, at which time both the complainant and the respondents appeared and presented testimony and exhibits on the complaint. The complainant presented a more defined articulation, including twenty items, of his initial request for records relating to the investigation of his claim of a hostile work environment.
A continued hearing was held on May 3, 2010, at which Gary Brochu of Shipman and Goodwin appeared on behalf of the respondents, in lieu of Louis Brey, who had just resigned his position as the Human Resources Director of the Danbury Public Schools. Also on May 3, 2010, more than 400 pages of responsive records were delivered to the complainant.
A second continued hearing was held on May 24, 2010, at which time additional responsive records were provided to the complainant. The respondents also stated that they were not claiming any exemptions from mandatory disclosure concerning the complainant’s records request, and that the respondent Superintendent of Schools would furnish a letter to the complainant stating that the respondents had provided to the complainant all records that they maintained within the scope of the complainant’s request. Such a letter dated June 23, 2010 was mailed to the complainant.
On June 28, 2010, the Commission received a letter from the complainant stating that he was withdrawing his complaint in the above captioned matter.
The Commission takes administrative notice of the complainant’s withdrawal and recommends the following orders on the basis of the record:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The Commission warmly commends the parties on having reached a settlement in this matter without full adjudication.
