The above-captioned matter was scheduled to be heard as a contested case on December 16 at 11:00 A.M., at which time the respondents appeared, but the complainant did not appear to prosecute the case. At the hearing, counsel for the respondents indicated that she has spoken with counsel for the complainant earlier in the week and earlier in the morning on the day of the scheduled hearing, and that he had indicated that he was not going to be pursuing this case by way of a contested case hearing. However, the complainant did not contact the Commission to inform it that this matter should be considered abandoned or withdrawn.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
