The above-captioned matter was heard as a contested case on February 28, 2011,  at which time the complainant and the respondents appeared and presented testimony, exhibits and argument on the complaint.   

 

            Prior to the issuance of the hearing officer’s report, by letter dated March 11, 2011, and received by the Commission on March 14, 2011, the complainant stated that he wished to withdraw his complaint.  The Commission takes administrative notice of such letter.

 

          The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  Based upon the withdrawal of the complaint, the case is hereby dismissed.
