The above-captioned matter was scheduled for hearing as a contested case on April 6, 2011, at which time both the complainant and the respondent appeared.
The complaint alleged simple violations of the time requirements for making both votes and minutes available for public inspection, following the respondent’s October 12, 2010 meeting. In response to an inquiry from the hearing officer, the respondent stipulated to these two violations of §1-225(a), G.S. The parties also agreed that counsel for the respondent would confer with the complainant concerning specific administrative measures to promote future compliance with the time requirements of §1-225(a), G.S.
The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Henceforth the respondent will strictly comply with the time requirements of §1-225(a), G.S., for making both votes and minutes available for public inspection following meetings.
2. The Commission warmly commends the parties for enabling an efficient adjudication of this case.
