The above-captioned matter was heard as a contested case on August 11 and September 22, 2011, at which times the complainant and the respondent appeared and presented testimony, exhibits and argument on the complaint.  The case caption has been amended to reflect the removal of Daniel Hunsberger as a complainant.

 

At the September 22, 2011 hearing in this matter, the complainant withdrew the complaint on the record.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  Based upon the withdrawal, the complaint is hereby dismissed.
