On April 11, 1979, the Commission considered and agreed to respond to the request for an advisory opinion filed by the Assistant Corporation Counsel, City of New Britain. Subsequently, a contested case was filed with the Commission placing in issue the same subject as that set forth in the applicant's request.

By letter dated May 23, 1979, the applicant notified the Commission that he desires that his request be withdrawn because the matter is now pending before the Commission in a contested case. Since the Commission prefers that this controversy by resolved through the vehicle of the pending contested case, it hereby withdraws, without prejudice, its grant of an advisory opinion in the above‑entitled matter.
