            The above-captioned matter was scheduled to be heard as a contested case on February 9, 1995, at which time neither the complainant nor the respondent appeared.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed for failure to prosecute.

 

            2.  The Commission admonishes the complainant for his failure to notify the Commission that he was not planning to appear for the scheduled hearing on this matter, which failure resulted in the unnecessary expenditure of state time and resources.
