The above-captioned matter was scheduled to be heard
as a contested case on August 30, 1995 at which time the complainants failed to
appear, however, the respondent appeared and presented argument on the
complaint. The respondent's request
that a civil penalty be imposed upon the complainant is denied.
The following order by the Commission is hereby
recommended on the basis of the record concerning the above-captioned
complaint:
1. The
complaint is hereby dismissed with prejudice.
2. The Commission
takes this opportunity to inform the complainants that their lack of courtesy
in attending the scheduled hearing or informing the Commission of their intent
not to appear caused significant waste of our state's scarse resources. The Commssion abhors such irresponsible
conduct.
