The above-captioned matter was heard as a contested
case on February 23, 1996, at which time the complainant and the respondent
appeared, stipulated to certain facts and presented testimony, exhibits and
argument on the complaint.
After consideration of the entire record, the
following facts are found and conclusions of law are reached:
1. The
respondent is a public agency within the meaning of 1-18a(a), G.S.
2. By letter
of complaint dated September 5, 1995 and filed with the Commission on September
7, 1995, the complainant appealed alleging that the respondent denied him
access to records, including records of phone conversations concerning his
Commission on Human Rights and Opportunities case No. 9430164 Jeffreys v.
Sikorsky Aircraft (hereinafter "CHRO case records").
3. It is
found that by letter dated August 25, 1995 the complainant requested that the
respondent provide him with access to the CHRO case records for the period
February 1993 though June 1993.
4. It is
found that by letter dated September 1, 1995 the respondent acknowledged
receipt of the complainant's August 25, 1995 letter, described in paragraph 3,
above, and indicated that his file could not be located, but once it had been
he would be contacted.
5. It is
found that on September 20, 1995 the respondent had a telephone conversation
with the complainant and at that time indicated that the only phone calls made
between February

1993 and June 1993 were those
informing the complainant that the CHRO case, described in paragraph 2, above,
would be investigated later in the year due to a backlog.
6. It is
found that the respondent has searched its files and do not maintain any
records responsive to the complainant's request for records of telephone
conversations or other records pertaining to the CHRO case for the period
February 1993 through June 1993.
7. It is
therefore concluded that the respondent did not violate 1-19(a), G.S.
The following order by the Commission is hereby
recommended on the basis of the record concerning the above-captioned
complaint:
1. The
complaint is hereby dismissed.
