The
above-captioned matter was heard as a contested case on August 5, 1996, at
which time the complainants appeared, but the respondent failed to appear. At the hearing, the complainants requested
reconsideration of their request for postponement filed on August 2, 1996,
which had been previously denied by the undersigned hearing officer, and were
unprepared to present the merits of their case.
The
following order by the Commission is hereby recommended on the basis of the
record concerning the above-captioned complaint:
1. The complainants’ renewed request for
postponement is hereby denied.
2. The complaint is hereby dismissed for
failure to prosecute.
