The above-captioned matter was heard as a contested case on November 1, 1996, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. The Report of Hearing Officer, dated February 7, 1997, was transmitted to the parties and considered at the February 26, 1997 Commission meeting, at which time the undersigned Hearing Officer withdrew his report.
Thereafter, the parties entered into a stipulation whereby the respondent agreed to provide the complainant with all of the requested records and, as a result, a "Withdrawal of Action" based on the stipulation was filed with the Commission.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
